Do you need a permit for a home EV charger?

If you’re installing a Level 2 EV charger at home, you’ll almost certainly need an electrical permit. That’s because a Level 2 charger requires a new dedicated 240V circuit tied into your electrical panel. A Level 1 charger that plugs into an existing outlet usually doesn’t require one. Exact rules vary by city, county, and state.

  • Level 1: the charger that comes with the car and plugs into a standard household outlet. It’s the slowest option, but if you’re using an existing outlet without touching the wiring, most jurisdictions don’t require a permit.
  • Level 2: a fixed station wired directly to your panel through a dedicated circuit. It charges much faster, and it’s the option that typically requires an electrical permit and, in many cases, a licensed contractor. The installation must also comply with the current National Electrical Code (NEC) and any codes adopted by your local jurisdiction.

What about Level 3? Level 3 (DC fast charging) is what you see at public stations and along highway corridors. It isn’t something installed at a home due to its cost and electrical requirements. For residential installs, only Level 1 and Level 2 apply — including a Tesla Wall Connector, which is a Level 2 charger and follows the same permit rules as any other Level 2 unit.

EV charger permits in Florida (Orlando, Davie, NOC)

Orlando / Orange County

The City of Orlando requires an electrical permit (with an associated engineering permit) to install an EV charging station, issued to a licensed general or electrical contractor. Orange County follows the same standard through its FastTrack system.

Davie (Broward)

The Town of Davie maintains a dedicated EV Charger checklist within its Electrical Division, separate from other permit types.

Notice of Commencement (NOC)

Under Florida Statute 713.13, once a project exceeds $2,500, you must record a Notice of Commencement before the first inspection. Practical example: if you install a Level 2 charger in your garage in Orlando, you’ll need an electrical permit, a possible panel load review, and a final inspection before you can use it.

California — statewide

California is the most interesting case: state law AB 1236 (Government Code §65850.7) requires every city and county to offer an expedited permitting process for EV charging stations — checklist-based review, same-day issuance when requirements are met (or a maximum of 5 business days), with fees capped at actual processing cost. A Level 2 charger still needs a permit, but the state requires that permit to move fast. A Level 1 charger on an existing outlet generally doesn’t need one. EV charger HOA rules: what the law actually says

  • Florida condominiums (Chapter 718): Florida Statute 718.113 states that a condominium declaration cannot prohibit a unit owner from installing an EV charger within their assigned parking space, as long as it doesn’t cause irreparable damage and is separately metered.
  • Florida single-family HOAs (Chapter 720): The same protection doesn’t exist here. Florida’s Homeowners’ Association Act (Chapter 720) has no equivalent EV charger provision — approval depends on your community’s recorded covenants and architectural review (ARC) process.
  • California: Civil Code §4745 requires the association to approve installation if the owner meets certain reasonable conditions (architectural standards, licensed contractor, insurance certificate) — it cannot prohibit or unreasonably restrict it.

When is a permit mandatory?

  • Installing a new dedicated 240V circuit
  • Any electrical panel capacity upgrade
